Following the announcement of the lawsuit, Elon Musk will officially go to court over his Twitter accusations on cave rescue driver Vernon Unsworth being a “pedo guy.”

The defamation lawsuit will see Musk in court October 22, and although his attorney suggested his client was only stating an “opinion,” Judge Stephen Wilson has confirmed the claim is substantial enough to go to trial. A pre-trial conference will begin October 7, where many speculate his lawsuit will end in a settlement.

This makes it the second time this year Musk has gone to court over Twitter, as he just recently reached an agreement with SEC over Tesla-related tweets. Unsworth was key in rescuing 12 stranded schoolboys and their football coach from a collapse in the Tham Luang caverns.

After Musk suggested a “kid-sized submarine” to help, Unsworth called it a PR stunt and for him to “stick his submarine where it hurts.” Musk retaliated by first alleging that he “Never saw this British expat guy who lives in Thailand (sus) at any point when we were in the caves.” and later adding “sorry pedo guy, you really did ask for it.”
