Twitter and Elon Musk To Go to Trial in October

Elon Musk and Twitter are scheduled to go to trial in October after Delaware Court of Chancery chancellor Kathaleen McCormick granted the social media platform’s plea.

Representatives for Twitter and Musk appeared in court for the first time today after Twitter filed its lawsuit against Musk for attempting to back out of his acquisition of the company for $44 billion USD in April due to the platform consisting of too many bots. According to reports, the social media giant initially requested a four-day trial in September, however, Musk responded by asking for a ten-day trial in February, adding that it wouldn’t be fair to go to court so soon. Judge McCormick ruled that the hearing will be expedited and take place in October for five days — slightly favoring Twitter as they asked for a shorter timeframe than Musk. The company slated Musk’s proposed timeframe, adding that it was “calculated to complicate and obfuscate.”

Twitter argued that it harms the company each day the dispute between Musk continues, therefore pushing for an earlier trial. “Millions of Twitter shares trade daily under a cloud of Musk-created doubt,” the company wrote. “No public company of this size has ever had to bear these uncertainties.”

Musk’s team is currently running millions of searches on data to better understand the platform’s calculations in which they prove that less than 5% of monetizable daily active users are bots. However, Musk’s team is firm on the belief that Twitter is downplaying the number of bots on its platform. The company claims that the issue is the macroeconomic downturn.
