adidas Wins Court Case Against Skechers Over Stan Smith

adidas AG recently won a case against Skechers USA Inc, where they stated that the latter ripped off the Stan Smith. The 9th U.S. Circuit Court of Appeals upheld a preliminary injunction, which barred Skechers from selling the Onix shoe after the sportswear giant alleged that it looked too similar to the Stan Smith.
Business of Fashion said that the Portland-based court did rule against adidas on another shoe called the Cross Court, which has 3 side stripes after finding that adidas wouldn’t suffer irreparable harm. The German company has sued Skechers multiple times over the last 2 decades, usually over the use of the 3-stripes logo. In this case, Judge Jacqueline Nguyen stated that the Stan Smith had “tremendous commercial success and market recognition” and that Skechers had deliberately misled costumers by directing searches for “adidas Stan Smith” to the Onix website.
However, when it came to the Cross Court shoe, Nguyen said “Adidas did not set forth evidence probative of Skechers’ allegedly less favorable reputation.”
