The latest development in the Elon Musk v Twitter has a Delaware court putting a stop to the billionaire’s request to push back the trial. While Musk loses the battle to delay the date of the trial, the judge has agreed to allow his team to use the claims made by Twitter’s whistleblower by former chief Peiter “Mudge” Zatko in his case.

While the trial is still set for October 17, Musk and his team of attorneys have argued for a few extra weeks to review any new information for the trial. Twitter has accused Musk of dragging out the trial and drawing chaos by requesting more documents. Chancellor Kathaleen McCormick has said that with even the slightest delay, Twitter could be harmed, “The company has been forced for months to manage under the constraints of a repudiated merger agreement. I am convinced that even four weeks’ delay would risk further harm to Twitter too great to justify.”

Overall, the ruling is on track with McCormick’s hope to push for a fast trial, however, the decision to allow the whistleblower’s statement to be used in Musk’s case, only strengthens his position. Musk originally said that he pulled out of the Twitter deal because he saw a large number of bots on the platform. Twitter on the other hand has subpoenaed a broad range of Musk’s allies and argues that Musk simply had cold feet and it had nothing to do with the bots. The trial begins on October 17 for five days.
