Tesla Can Sue Cybertruck Resellers for $50,000 USD
Looking to maintain the exclusivity of the model.
According to a report, Tesla’s purchase agreement for the Cybertruck includes a “Cybertruck Only.” The clause states that buyers cannot sell their vehicle within the first year unless they have explicit permission from the automaker. Breaking the agreement may result in the owner being sued by the auto manufacturer. With deliveries of the Cybertruck on track for November 30, Tesla updated its Motor Vehicle Order Agreement which has now been circulated across the Internet.
The new terms state it “may seek injunctive relief to prevent the transfer of title of the Vehicle,” or it may “demand liquidated damages from you in the amount of $50,000 or the value received as consideration for the sale or transfer, whichever is greater.” The terms go on to also note that resellers could be barred from buying Tesla vehicles in the future.
While some exceptions can be granted, resellers must get written consent from Tesla. Tesla will either buy the car back at a reduced price, deducting $0.25 USD per mile driven, plus wear and tear, and the cost of any necessary repair, or the sale to a third-party buyer.
