HYPEBEAST AR EXPERIENCE & SOCIAL MEDIA GIVEAWAY TERMS AND CONDITIONS

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE RESTRICTED OR PROHIBITED BY LAW.

1. Promotion Description: By participating in the giveaway prize competition (“Giveaway”), each entrant unconditionally accepts and agrees to comply with and abide by the Giveaway terms and conditions herein (“Rules”), the relevant Website Terms of Use and Privacy Policy together with the decisions of the Sponsor, Hypebeast Hong Kong Limited (“Hypebeast”), which shall be final and binding in all respects. Hypebeast is responsible for the collection, submission and processing of entries and the overall administration of the Giveaway. Entrants should look solely to Hypebeast with any questions, comments or problems related to the Giveaway. This Giveaway is offered only in the United States and shall be governed by, and construed in accordance with, the State of New York, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts for New York County, New York.
2. Eligibility: This Giveaway shall only be open to legal residents of any of the fifty (50) United States or the District of Columbia who are eighteen (18) years or older (nineteen (19) or older for Alabama and Nebraska) at the time of entry. The following persons are not eligible to participate: Employees, contractors, directors, and officers of Hypebeast and The Quaker Oats Company and each of their respective parents, subsidiaries and affiliated companies, distributors, Web design, advertising, fulfillment, judging and promotion agencies involved in the administration, development, fulfillment and execution of this Giveaway (collectively, “Promotion Parties”), and the immediate family members (spouse, parent, child, sibling, grandparent, and/or “step”) of each and those living in their same households (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Giveaway).
3. Winner Selection:
   1. AR Experience: The AR Experience is open from August 14, 2024 at 12:00 AM EST to September 4, 2024 at 11:59 PM EST (“AR Promotional Period”). Successfully complete all tasks as instructed within the three (3) worlds of the Cap’n Crunch Crunch Verse AR Experience, and complete the registration form upon completion of the tasks for an entry into the AR Experience Giveaway. Limit one (1) entry per person/email address. Prizes shall be provided by Hypebeast. There shall be a total of ten (10) winners and each winner may win one (1) Capsule Collection, which includes three (3) items. Winners will be selected in a random drawing from all eligible entries received by Hypebeast. Selection is conducted by Hypebeast or its designated representatives, whose decisions are final. Selected winner must reply by email within 24 hours of notification and acknowledge acceptance of the prize as directed by Hypebeast. If the selected winner did not respond or notification is returned as undeliverable, it may result in prize forfeiture. The potential prize winner may be required to sign and return a declaration of eligibility and release of liability (collectively “Prize Claim Documents”). Entry and prize are not transferable to another individual, cash or alternatives will also not be offered. The potential prize winner is solely responsible for any taxes on the prize and may receive an IRS Form 1099 for the value of the prize.
   2. Social Media Giveaway via Instagram: Hypebeast shall host and administer a social media sweepstakes that complies with all applicable law for eligible participants to win one (1) piece from the Capsule Collection (“Social Giveaway”). The Social Giveaway begins at the time of Hypebeast’s sweepstakes post discussed below on or about September 5, 2024 and ends September 12, 2024 at 11:59 PM EST (“Social Giveaway Promotional Period”). Limit one (1) entry per person. There shall be a total of ten (10) winners and each winner may win one (1) piece from the Capsule Collection. Winners will be selected in a random drawing from among all eligible entries received by Hypebeast. For purposes of clarification, there shall be a total of ten (10) pieces from the Capsule Collection given away in this Social Giveaway. The rules of the Social Giveaway will include, but are not limited to:
      1. Look for Hypebeast’s sweepstakes post on Instagram.com/Hypebeast (@hypebeast on Instagram) on or about September 5, 2024 (exact time of post to be determined by Hypebeast at a date later than the publishing of these Rules). Entrants must complete the below by September 12, 2024 at 11:59 PM EST to be considered for the Social Giveaway:
         1. Follow @realcapncrunch, @advisry and @hypebeast on Instagram;
         2. Comment your favorite Cap’n Crunch cereal flavor: Original, Crunch Berries or Peanut Butter Crunch, tag @realcapncrunch, and include the hashtag #hypebeastsweepstakes; and
         3. Like the giveaway post on Instagram.
      2. Upon completion of the above requirements within the designated timeframe, Hypebeast will randomly select ten (10) winners to receive one (1) piece from the Capsule Collection. Hypebeast to be responsible for shipping of selected item from capsule to selected winners. Selection is conducted by Hypebeast or its designated representatives, whose decisions are final. Selected winner must reply within 24 hours of direct message notification and acknowledge acceptance of the prize as directed by Hypebeast. If the selected winner did not respond or notification is returned as undeliverable, it may result in prize forfeiture.
4. Prizes:
   1. AR Experience: A total of ten (10) Collection Capsule prizes will be awarded, each prize consisting of: one (1) Hoodie (approximate retail value (“ARV”): $240.00), one (1) Hat (ARV: $110.00), and one (1) Charm Bracelet (ARV: $280.00.) Total ARV of all prizes USD $630.00. Hypebeast cannot guarantee requests for specific sizes will be met. Only one prize per person and per household will be awarded. Prizes cannot be transferred, redeemed for cash or substituted by winner. Prizes will be shipped to the winner within 4- 6 weeks of the Social Giveaway ending (except where there is delay in prize logistics and shipment arrangement that are out of Hypebeast’s control). Hypebeast reserves the right in its sole and absolute discretion to award a substitute prize if a prize described in these Rules is unavailable or cannot be awarded, in whole or in part, for any reason. Hypebeast makes no representation or warranty concerning the appearance, condition, safety or performance of any prize awarded. Restrictions, conditions, and limitations may apply. Hypebeast will not replace any lost or stolen prize items. Prize will only be awarded and/or delivered to physical addresses. P.O. Box address is not permitted or accepted. All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the selected prize winner. Failure to comply with any of these Rules will result in forfeiture of the prize.
   2. Social Giveaway via Instagram: A total of ten (10) prizes will be awarded, consisting of: one (1) Hoodie (AR: $240.00), one (1) Hat (ARV: $110.00), or one (1) Charm Bracelet (ARV: $280.00). Total ARV of all prizes USD $6,300.00. Hypebeast cannot guarantee requests for specific sizes will be met. Only one prize per person and per household will be awarded. Prizes cannot be transferred, redeemed for cash or substituted by winner. Prizes will be shipped to the winner within 4-6 weeks of the Social Giveaway ending (except where there is delay in prize logistics and shipment arrangement that are out of Hypebeast’s control). Hypebeast reserves the right in its sole and absolute discretion to award a substitute prize if a prize described in these Rules is unavailable or cannot be awarded, in whole or in part, for any reason. 5. Automated or robotic entries submitted by individuals or organizations will be disqualified immediately. Internet entry must be made by the entrant personally. Any attempt by an entrant to obtain more than one entry by using multiple/different email addresses, residential addresses, identities, registrations, logins or any other methods will void that entrant’s entries and that entrant will be immediately disqualified. Final eligibility for the award of any prize is subject to eligibility verification as set herein.  In the event of a dispute concerning who registered online to participate in the Giveaway, the registration will be declared to have been made by the authorized account holder, which is defined as the natural person who is assigned to an email address by an internet provider, online service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Hypebeast’s database clock will be the official timekeeper for this Giveaway.
6. Privacy: All entrants acknowledge that if they are chosen as a winner, certain personally identifying information may be disclosed to third parties at least as required by law, including, without limitation, on a winner’s list. All personal information submitted as part of the Giveaway will be used in accordance with Hypebeast’s online privacy policy (https://hypebeast.com/privacy).
7. Any personal information that entrants share with Hypebeast will be kept secure and used as per the Rules and aforesaid privacy policy. Entrants agree that all submitted information may be used by Hypebeast to administer this competition. For competition entries and opt-in to receive marketing communications from Hypebeast, the Data Controller (as defined under applicable data protection legislation) is Hypebeast (for further information, please refer to the privacy policy of Hypebeast - https://hypebeast.com/privacy).
8. Limitation of Liability: Hypebeast is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Giveaway or by any technical or human error, which may occur in the processing of submissions in the Giveaway. Hypebeast assumes no responsibility for any misdirected or lost mail, or any error, omission, interruption, deletion, defect, delay of operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries.
9. In the event of a dispute concerning who registered online to participate in the Giveaway, the registration will be declared to have been made by the authorized account holder is defined as the natural person who is assigned to an email address by an internet provider, online service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be requested to provide Hypebeast with proof that the potential winner is the authorized account holder of the email address. If a dispute cannot be resolved to Hypebeast’s satisfaction, the entry will be deemed ineligible.
10. By entering the Giveaway, you, as entrant, agree (for yourself and your heirs) that Hypebeast and The Quaker Oats Company and each of their respective parents, subsidiaries, affiliates, officers, employees, contractors and agents, and any entity involved in any aspect of this Giveaway (all aforementioned parties are collectively, the “Released Parties”) will have no liability, and will be held harmless from and against liability, loss, injury or damage to property or person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in the Giveaway. Nothing in these Rules shall seek to limit or exclude liability on behalf of any of the Released Parties for death or personal injury caused by negligence or fraudulent misrepresentation.
