McDonald’s is facing a legal firestorm over its most elusive menu item. A federal class-action lawsuit, filed on December 23 in the Northern District of Illinois, alleges that the Chicago-based giant has been misleading the public for years regarding the actual composition of the McRib. The core of the complaint? Despite the suggestive name and marketing, the plaintiffs claim the sandwich contains absolutely no actual pork rib meat.

The legal challenge was spearheaded by four individuals who argue that the branding is a calculated deception. According to the filing, a reasonable customer would “reasonably believe that a product named the ‘McRib’ will include at least some meaningful quantity of actual pork rib meat.” Instead, the lawsuit suggests that the “seasoned boneless pork” described on the McDonald’s website is a clever linguistic workaround for a product that mimics the shape of a rib without the anatomical reality to back it up. The lawsuit also claimed that McDonald’s has “cultivated a sense of anticipation around the McRib, leveraging its scarcity to drive sales across its many locations.” It adds, “Put simply: consumers have been materially misled en masse as a result of McDonald’s deceptive labeling and marketing into purchasing sandwiches that they would not otherwise have purchased, or would only have paid less for, had they known the truth.”

Currently, McDonald’s describes the cult-favorite as a combination of pork, tangy BBQ sauce, slivered onions, and pickles on a toasted homestyle bun. However, the plaintiffs contend that by shaping the meat to resemble a slab of ribs—complete with faux “bone” ridges—McDonald’s is reinforcing a false narrative that the meat is sourced from the rib cut. The lawsuit also notes that despite the McRib not containing any rib meat, the sandwich is one of McDonald’s most expensive items on its menu. Following the lawsuit, McDonald’s released its own statement, “This lawsuit distorts the facts and many of the claims are inaccurate. Food quality and safety are at the heart of everything we do – that’s why we’re committed to using real, quality ingredients across our entire menu. Our fan-favorite McRib sandwich is made with 100% pork sourced from farmers and suppliers across the U.S. We’ve always been transparent about our ingredients so guests can make the right choice for them.” As the case moves forward, it raises a significant question for the fast-food industry: where is the line between creative branding and consumer fraud?
