Nike Files Preliminary Injunction Against Warren Lotas Over Replacement Sneaker

Claiming the “Reaper” still looks like an SB Dunk Low.

Shortly after Warren Lotas introduced his new Reaper silhouette, Nike is now taking action against the replacement sneaker model for the designer’s “SB Dunk Low rip-offs” that launched the legal saga.

According to reports, the sportswear filed yet another preliminary injunction earlier this week against Lotas’ proposed resolution. In the latest filing, Nike argues that Lotas responded to the original injunction three days late and his response shows that he is not looking to stop the infringement as requested as images of the shoes still appear on Lotas’ Instagram. Nike goes on to note that the Reaper is a “blatant bait-and-switch” that still resembles a Nike SB Dunk Low.

“[Warren Lotas] never presented these ‘replacement’ sneakers to Nike for its review or approval,” reads the filing. “If it had, Nike would have likely told [Lotas] that the ‘replacement’ sneakers are unacceptable because they appear to still infringe at least some of Nike’s Dunk trade dress registrations. For example, the ‘replacement’ sneakers appear to have at least the same or a similar infringing outsole as the WL Pigeon and WL Broccolini sneakers.”

It is being reported that the first preliminary injunction filed last week will proceed due to the untimely opposition and continued infringement with a judge scheduled to make a decision November 19.
