These are definitely not legit. I wouldn't recommend it at all, sorry! If you want a pair of Beats then go to your local Best Buy, anyone selling them discounted online are fake! Even local deals I wouldn't trust, too many kids trying to make fast money.
Honestly, I wouldn't think so.
Unless you've gotten used to listening to authentic Beats for a long time, the difference isn't super obvious in the quality.
If you're just going for the brandy look with Beats, then by all means, get the cheap ones as people can't really tell the difference, but I still recommend going for the authentic version.

People sell LV items with fake receipts all the time.
Plus, the 2nd link posted is most definitely a fake, if they're selling one fake, what are the chances the others are legit?
And it really depends what fakes you get, as some are sub par quality whereas some are somewhat close to the real ones.
But what I'm saying is if you don't have experience with Beats headphones and you were to compare good fakes and legits the different would be hard, but not impossible.
If they're selling a good fake, probably not, they usually nail the looks.
If you're buying a red pair, the fakes look more dark red than a bright red, hard to tell unless you have side by side comparison.
Feel for the material of the wire too, fakes feel like straight plastic or rubber.
If you're getting one with control talk, make sure it's on the right wire not left.
